Terms and conditions

These General Terms and Conditions of Sale (hereinafter, “Terms”) govern the purchase of products through marcasitios.es, owned by Iván Márquez, in compliance with Spanish Royal Legislative Decree 1/2007 approving the consolidated text of the General Law for the Defence of Consumers and Users (LGDCU), and the LSSICE.

2. Subject and product description

Marcasitios offers wedding place cards digitally personalized from real photographs provided by the customer, delivered as a high-resolution digital file ready to print, for weddings and events. Each item is personalized and unique, produced on consumer order pursuant to art. 103.c LGDCU. The service does not include physical printing or shipping of material products.

3. Purchase process

• The customer creates an order indicating the number of guests, style and contact details.
• The customer uploads each guest's photograph and the required data.
• Before payment, the customer expressly accepts these Terms, the Privacy Policy, the non-acceptance of refunds once illustration has begun, and the availability of consent of the persons photographed.
• Payment is made via Stripe. Marcasitios does not store card data.
• Once payment is confirmed, we begin producing the illustrations.

4. Prices and taxes

Prices are shown in euros and include applicable VAT. There are no shipping costs as this is a digital product.

5. Delivery of the digital file

The digital file will be delivered by email within the indicative timeframe shown on the order page, starting from full delivery of guest photographs and data. Marcasitios undertakes to deliver with sufficient time before the event date provided the recommended timeframes are respected.

6. Right of withdrawal — Exceptions

In accordance with art. 103, letters a), c) and m) of the LGDCU, the right of withdrawal does not apply to contracts relating to:

• Goods made to the consumer's specifications or clearly personalized.
• Services fully performed or whose performance has begun with the consumer's prior and express consent.
• Digital content not supplied on a tangible medium when performance has begun with the consumer's prior and express consent.

Once illustration has begun or the digital file has been delivered, refunds or returns are not accepted. The customer expressly accepts this condition by ticking the corresponding box before payment.

7. Use of photographs

Photographs provided by the customer will be used exclusively to create the illustrations for the order and will be deleted within a maximum of 30 days after delivery. See details in Privacy Policy — Processing of photographs. The customer warrants that they have the consent of the persons appearing in them.

8. Intellectual property of the illustrations

The illustrations delivered are for the customer's personal and non-commercial use in the context of the event. Marcasitios retains its moral copyright and may display samples of its work (without personally identifiable data) in its portfolio unless the customer states otherwise in writing.

9. Warranties and claims

If the delivered file contains errors clearly attributable to Marcasitios, you have 14 calendar days from receipt to report it to hola@marcasitios.es. We will correct it at no cost.

10. Out-of-court dispute resolution

Consumers may access the European online dispute resolution platform at ec.europa.eu/consumers/odr.

11. Applicable law

These Terms are governed by Spanish law. The competent Courts and Tribunals shall be those of the consumer's place of residence.
